Terms and Conditions for Equinox Drives

Welcome to Equinox Drives. These Terms and Conditions govern your use of our online platform and the services we provide, including luxury BMW car rentals, seasonal adventure packages, corporate rentals, and long-term leases. By accessing or using our online platform, you agree to comply with and be bound by these Terms and Conditions. If you do not agree to these Terms, please do not use our services.

1. Definitions

• "Equinox Drives," "we," "us," or "our" refers to Equinox Drives, the company providing luxury car rental services.
• "User," "you," or "your" refers to any individual or entity accessing or using our online platform and services.
• "Services" refers to our luxury BMW car rental services, seasonal adventure packages, corporate rentals, and long-term leases offered through our online platform.
• "Online Platform" refers to our website and any related online services provided by Equinox Drives.

2. Eligibility

To use our Services, you must be at least 25 years old, possess a valid driver's license for a minimum of 2 years, and have a valid credit card in your name. Additional eligibility requirements may apply for specific vehicle models or rental durations, as outlined during the booking process.

3. Booking and Reservations

All bookings are subject to vehicle availability. A reservation is confirmed only after full payment or a specified deposit has been successfully processed and you receive a confirmation email from Equinox Drives. We reserve the right to decline any booking at our discretion.

• Pricing: All prices are displayed in GBP and are subject to change without prior notice. The price confirmed at the time of booking will be honored.
• Payment: Payment can be made via major credit cards. A security deposit will be required at the time of vehicle collection, the amount of which varies depending on the vehicle model and rental duration.
• Cancellation Policy: Cancellation terms are detailed during the booking process and in your confirmation email. Typically, cancellations made within a certain timeframe will incur a fee, while late cancellations or no-shows may result in the forfeiture of the deposit or full rental amount.

4. Vehicle Use and Responsibilities

You agree to use the rented vehicle responsibly and solely for its intended purpose. The following conditions apply:

• The vehicle must not be used for racing, off-roading, or any illegal activities.
• Only authorized drivers listed on the rental agreement are permitted to operate the vehicle.
• You are responsible for all fines, penalties, and towing charges incurred during the rental period.
• The vehicle must be returned in the same condition as it was received, subject to normal wear and tear. Any damage found upon return will be charged to you.
• Smoking is strictly prohibited in all our vehicles. A cleaning fee will be charged if this rule is violated.
• Fuel policy: Vehicles are provided with a full tank and must be returned with a full tank. Otherwise, refueling charges plus a service fee will apply.

5. Insurance

Our rental vehicles come with comprehensive insurance coverage. However, an excess amount will apply in the event of damage or theft, for which you will be responsible. Optional additional insurance products may be available to reduce your liability, details of which will be provided at the time of booking or collection.

6. Seasonal Adventure Packages and Corporate Rentals

Specific terms and conditions may apply to seasonal adventure packages and corporate rentals. These will be communicated to you directly and will supersede any conflicting general terms listed here for those specific services.

7. Intellectual Property

All content on our online platform, including text, graphics, logos, images, and software, is the property of Equinox Drives or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, or create derivative works from any content without our express written permission.

8. Limitation of Liability

To the fullest extent permitted by law, Equinox Drives shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use our services; (ii) any conduct or content of any third party on our online platform; (iii) any content obtained from our online platform; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

9. Indemnification

You agree to defend, indemnify, and hold harmless Equinox Drives and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of our services, by you or any person using your account and password; b) a breach of these Terms, or c) content posted on the online platform.

10. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Scotland, without regard to its conflict of law provisions. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Scotland, UK.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised terms.
